Terms of Service
Rules and guidelines for using FlatSe.
1. Acceptance of Terms
By accessing or using FlatSe (“the Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Platform. These Terms apply to all users, including society committees (administrators) and individual residents (members).
2. Description of Service
FlatSe is a communication and helpdesk platform designed for apartment societies. The Platform provides tools for publishing notices, managing events, conducting polls, tracking maintenance complaints, and storing society documents. FlatSe is not an accounting system, security management tool, or full-featured ERP.
3. Eligibility
- You must be at least 13 years of age to use the Platform.
- Society administrator accounts must be created by authorised representatives of a registered Resident Welfare Association (RWA), society, or apartment management body.
- Resident accounts must be associated with a valid flat/unit within a registered society on the Platform.
4. Account Responsibilities
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to provide accurate and complete information during registration.
- You must notify us immediately of any unauthorised use of your account.
- Society administrators are responsible for managing member access within their society.
5. Acceptable Use
You agree not to use the Platform to:
- Post content that is defamatory, abusive, threatening, or harassing
- Share false or misleading information
- Distribute spam, unsolicited advertisements, or promotional material
- Impersonate any person or entity
- Attempt to access other societies' data or bypass security measures
- Use the Platform for any illegal activity
- Upload malicious software or code
6. Content Ownership
- Your content: You retain ownership of content you post on the Platform (notices, event details, complaints, documents).
- Licence grant: By posting content, you grant FlatSe a non-exclusive, worldwide licence to host, display, and distribute that content within your society as necessary to provide the service.
- Society data: All society-specific data belongs to the society. FlatSe does not claim ownership of any society content or data.
7. Society Administration
- Society administrators have the authority to manage members, publish notices, create events and polls, and oversee complaint management within their society.
- Administrators are responsible for ensuring that content posted through admin channels complies with applicable laws and regulations.
- FlatSe is not responsible for decisions made by society administrators through the Platform.
8. Service Availability
We strive to maintain high uptime and reliability. However, the Platform may experience occasional downtime for maintenance, updates, or unforeseen technical issues. We do not guarantee uninterrupted service and are not liable for any losses resulting from service interruptions.
9. Fees and Payment
FlatSe may introduce subscription fees for societies. Pricing details will be communicated individually to early access participants and published publicly when available. Early adopter pricing, once agreed, will be honoured for the duration specified in the agreement.
10. Data and Privacy
Your use of the Platform is also governed by our Privacy Policy. By using FlatSe, you consent to the collection and use of data as described in the Privacy Policy.
11. Termination
- By you: You may delete your account at any time through the Platform settings.
- By society administrators: Administrators may remove members from their society.
- By FlatSe: We may suspend or terminate accounts that violate these Terms, with reasonable notice where possible.
- Data after termination: Upon society account termination, we will provide a data export and delete society data within 90 days.
12. Limitation of Liability
To the maximum extent permitted by applicable law, FlatSe shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Platform.
13. Indemnification
You agree to indemnify and hold harmless FlatSe, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform or violation of these Terms.
14. Modifications to Terms
We may modify these Terms from time to time. We will notify registered users of material changes via the Platform or email at least 30 days before the changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the modified Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.
